The Consumer Protection Division of Eastman Libersat, P.C. is devoted to helping stop abusive creditors and debt collectors from harassing consumers and violating their rights. The Fair Debt Collection Practices Act (FDCPA) prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you. Certain state-specific laws provide similar protections with respect to first-party creditors as well. Often times, the tactics of collectors and creditors also violate the Telephone Consumer Protection Act (TCPA). The TCPA restricts certain telemarketing calls, calls placed with an automatic dialing system, calls that use a prerecorded or artificial voice, robocalls, text messages and faxes. Those that have experienced a violation of the FDCPA may be entitled to recover statutory damages of $1,000.00, actual damages, court costs and attorney’s fees. The TCPA provides for statutory damages of up to $1,500.00 for each willful call, text or fax that results in a violation.
